CODE ENFORCEMENT

The 2025 RESIDENTIAL CODE OF NEW YORK STATE came into effect on December 31, 2025.

The Code Enforcement Officer/Town of Galway Building Inspector is responsible for applying and enforcing all New York State Residential and Commercial Building Codes, and Town of Galway Zoning and Building Codes. This includes issuance of Building Permits and performing subsequent inspections. Additionally, as Zoning Administrator, they review applications filed before the Zoning Board of Appeals and Planning Board.

BEFORE undertaking any construction or demolition which is covered by 2025 Residential Code of New York State or Town of Galway Codes, it is your responsibility to obtaining a building permit. Most building projects in the Town of Galway require a building permit. If you are unsure if a permit is needed, please contact the Code Enforcement Officer before you start work. Permits could take at least two (2) weeks to review and process during the main construction season. If you need Zoning Board approval for your project, it may take two (2) months or more. Please plan accordingly.

911 address numbers must be visible from the road in both directions.

It is the permit holder’s responsibility to request required inspections, giving a minimum of 24 hours’ notice to the Building Inspector. Inspections can be requested by email or phone call. You must receive confirmation that the Building Inspector is available at your requested time. Failure to request any required inspection may prevent the issuance of a Certificate of Occupancy or Certificate of Compliance.

The Building Inspector is required to perform the following inspections:

  1. Foundation Footings BEFORE the pouring of concrete.
  2. Foundation BEFORE backfilling.
  3. Septic System BEFORE backfilling. Be sure there is adequate water to test the level of the distribution box.
  4. Plumbing, heating, framing and electrical BEFORE closing in framework. Electrical inspections are conducted by a third-party inspector.
  5. Final inspection for a Certificate of Occupancy. BEFORE residing in a dwelling, a Certificate of Occupancy must be obtained, there are no exceptions.
  6. Prior to any use (additions, accessory structures, decks, swimming pools, fuel burning appliances etc.), a final inspection for a Certificate of Compliance is required.

However, you are encouraged to schedule an appointment to avoid possible conflicts with onsite inspections and other scheduled meetings. Days with Planning Board, Zoning Board of Appeals, or Town Board Meetings, office hours are 12-5 PM. (Check the EVENTS tab at the top of this page for meeting dates.)
